Litigation is simply a client’s representation in court or other dispute resolution arenas such as arbitration, licensing boards, and government agencies. The common aspect of litigation is that it involves a dispute among individuals, corporations, and/or government agencies or departments.

Although litigation foresees the potential for a lawsuit and a trial, many matters handled by litigators are resolved by settlement, either before the initiation of a lawsuit or if a lawsuit is begun, before trial. As such, the skills of a litigator go beyond trial practice and include negotiation and alternative paths to settlement, such as mediation.
